SERVICE TERMS AND CONDITIONS

These Terms and Conditions shall govern the access and use of the Digital Showcase Hub and the Services offered through it. These Terms and Conditions apply to both registered and un-registered users (hereinafter, the “Users”) who access the Services (as defined herein).

Terms and Conditions Applicable to Registered Users

With respect to registered Users, these Terms and Conditions shall apply in their entirety, and shall be understood to have been accepted upon checking the relevant box during the registration process. The creation of a Profile and the use of the Services that are accessible subject to registration shall entail the full and unconditional acceptance of all the provisions contained in these Terms and Conditions.

Terms and Conditions Applicable to Unregistered Users

As to unregistered Users, these Terms and Conditions shall apply limited to (i) any provisions relating to basic services, meaning services that can be accessed without registration (including, but not limited to, browsing and accessing the contents of the Digital Showcase Hub); and (ii) any general provisions which, by their very nature, do not require the express consent of the User, including, in particular, any provisions relating to intellectual property, [customer] assistance, the processing of personal data and privacy, and any obligations arising out of Regulation (EU) 2022/2065 on digital services (Digital Services Act or “DSA”). Such provisions are made available and are accessible at all times on the Digital Showcase Hub in order to ensure full knowledge thereof by anyone accessing the Digital Showcase Hub.  Please also note that some of the services that are accessible through the Digital Showcase Hub are not managed directly by Trentino Marketing, but by third parties, as further clarified, where relevant, throughout these Terms and Conditions. It is therefore understood that, with regard to said services, Trentino Marketing shall be understood to not be a party to the contractual relationship thereby established between the User and a third-party provider.

 

1. Purpose

1.1 These terms and conditions (hereinafter, the “Terms and Conditions”) shall regulate the Users’ access to and use of the services (hereinafter, the "Services”) made available by Trentino Marketing S.r.l. through its technological Platform (as defined herein) integrated to and accessible through 

a)     the “Mio Trentino” mobile app for iOS and Android (the “App”); 

b)    the www.visittrentino.info website and linked pagers (the “Website”); 

c)     any other digital channel the Company may make available. 

1.2       The Services include, among others, tourist information, travel experience customisation, the “Digital Showcase Hub”, and every other complimentary and/or accessory service made available through the Platform (as defined herein) within the territory of the Autonomous Province of Trento. The Digital Showcase Hub is understood as a tool to provide information and enable connections, and does not operate as an intermediary in commercial transactions. All the operations for bookings and purchasing the Products take place exclusively outside the Digital Showcase Hub, on booking systems that are managed directly by APTs (Local Tourism Boards) and/or Providers, and the Company is not a party to the relative contracts. 

1.3       Trentino Sviluppo S.p.A. (hereinafter, “Trentino Sviluppo”) entrusted Trentino Marketing S.r.l.

with the operating management of the Marketing Section of the Fund for the development of Trentino’s economy as per Article 33, paragraph 1, letter “a bis” of Provincial Law No. 6 of 1999, for the implementation of the activities set out under Law 6, and of Article 9 of Provincial Law No. 8 of 2020, within the scope of the business purpose stated in the Trentino Marketing S.r.l.’s articles of association, and in accordance with the express power of attorney granted thereto.

1.4       These Terms and Conditions are drawn up by Trentino Marketing S.r.l. with registered office address at Via Romagnosi, 11, Trento (Italy), VAT Number 02341869225, also on behalf and in the name of Trentino Sviluppo S.p.A., and shall hereinafter be simply referred-to as the “Company”.

1.5       In consideration of the strengthened protection the Company intends to grant to minors under the age of 18, use of the Services through the Profile is allowed only to Users over the age of 18 and who are registered with the Website. The basic information Services offered through the Website are not subject to age restrictions.

1.6       The Services are intended for personal use, and not for business purposes. Any use thereof for purposes of re-sale, unauthorised intermediation in commercial transactions, or competing business activities is not allowed. The User must carefully read the following Terms and Conditions before using the Services.

1.7       Some of the provisions in these Terms and Conditions apply exclusively to specific Services and/or digital channels. Where a specific provisions only concerns one or more Services or a specific channel, this shall be expressly specified in the relevant sections or notices. The above provisions shall be understood to only apply to Users who use the Services or channels to which they refer.

2. Definitions

     Platform: the integrated technological ecosystem consisting of the “Mio Trentino” mobile app, the “visitrentino.info” website (which includes the Digital Showcase Hub) and any other channel through which the Company offers the Services, including the holiday planning service, currently known as Trentino Travel Assistant (hereinafter “Trentino Travel Assistant”).

     Services: integrated set of digital tourist services and activities provided by the Company through the Platform, including:

a)    basic information services: access to tourist content, events, attractions, weather information, available without registration;

b)    tailored services: creation of a Profile, customised itineraries, preferences, reviews, dedicated assistance, use of the Trentino Guest Card;

c)     search and consultation services: search, browsing, and connection to the booking systems of APTs and Providers within the scope of the Digital Showcase Hub.

     User/s: natural person who uses the Platform to access the Services, whether registered or not;

     Profile: personal profile of a registered User, consisting of a set of identification details and preferences, and enables access to customised services.

     Digital Showcase Hub: section of the Platform that allows to search and browse through promotions relative to the Products, and provides a connection to the booking systems of APT and/or Providers.

     Products: goods and/or services (including hospitality and tourist experience services) operated or provided by APTs and/or Providers within the Autonomous Province of Trento and promoted through the Digital Showcase Hub;

     Provider/s: parties, other than the Company, who offer tourist Products and uses the Digital Showcase Hub for their promotion and presentation;

     APT: Tourist Boards of the Autonomous Province of Trento who use the Digital Showcase Hub to promote the territory and the Products offered by business operators within the territory.

     Trentino Guest Card: digital pass valid for the same duration of a visitor’s stay (including day of arrival and departure) through which visitors have access to the services offered, including, but not limited to, transport, museums, castles, activities, discount codes, governed by their relative terms and conditions of use, available at https://www.card.visittrentino.it/img/GeneralTermsPrivacy.pdf;

     Booking Channel: technological online booking systems managed by APTs and/or Providers

(including Deskline systems) for the direct sale of the Products, made available on the Digital Showcase Hub;

     Inter-field Link Key: technical operation aimed at giving an aggregated, combined view of the offers published by an APT and/or by the Provides on their respective channels, including by making use of the groupings created by APTs or Providers into Product or Project Group or other inter-field initiatives;

     Content: content and material regarding APTs, the Provider and their Products, published on the Digital Showcase Hub.

3.             Content

         3.1     The Digital Showcase Hub’s contents are divided into the following categories:

a)     Company Product Content: information on the Company, general description of the territory, technical functionalities of the Services.

b)    Content provided by APTs and Providers: description of accommodation facilities, tourist Products, prices, availability, images, itineraries, events. The latter content falls under the exclusive responsibility of APT and/or Provider who publishes it.

         3.2     With respect to the Content under letter b) above, the Company

a)    assumes no responsibility whatsoever, it being understood that such Content is published by third parties, and the Company does not systematically conduct any prior checks on the same;

b)    undertakes to promptly remove or disable access to illegal or manifestly inappropriate content, including, by way of example and not limitation,  content that harms third-party rights, defamatory, discriminatory, violent, or fraudulent content, or content in breach of intellectual property rights;  

c)     reviews and checks, within 7 working days, whether notices regarding potentially illegal or inappropriate content are substantiated;

d)    retains the right to remove content at its own discretion due to the violation of the Terms and Conditions;

e)    declines any responsibility for any inaccurate, missing, or obsolete information found in the Content published by third parties.

3.3       Users can notify Trentino Marketing of illegal or inappropriate Content by writing to: webmaster@trentinomarketing.org or filling-in the dedicated online form. In order to be considered complete and suitable to provide actual knowledge of illegal or inappropriate content under the DSA, a notice must include: (i) clear indication of the Content being notified, by providing a URL or a screenshot; (ii) specific reason why the User submitting the notice alleges the Content to be illegal or inappropriate; (iii) legal framework infringed; (iv) name and address of the person submitting the notice; (v) statement confirming the bona fide belief of the User submitting the notice that the information  contained therein are accurate. The Company shall send a receipt confirmation, gives priority to investigating notices submitted by trusted flaggers specially appointed to such task under the DSA, and takes measures against the misuse of the notice-and-action system.

3.4       With specific reference to the App, in order for a User to access the Services, they must use a device that is equipped with appropriate functionalities and network operability, including an updated operating system where required, and geolocation enabled for any services that require the User’s position in order to function correctly. Services may appear limited or unavailable due to insufficient network coverage, adverse weather conditions, the mountain features and terrain of the Trentino region's territory, or maintenance work on network infrastructure.  The Company assumes no responsibility for limited Services arising from any factors beyond its control. 

3.5       The Services can be accessed 24/7, every day of the year. However, access to the Services may be temporarily suspended due to ordinary and extraordinary maintenance, urgent security updates, technological infrastructure failures, or events of force majeure.  The Company undertakes to minimise any Service disruptions, to the extent possible. 

4. Qualification of the Service and Limitation of Liability 

4.1 The Company provides a search and consultation service, including the presentation of offers, services and tourist experiences, enabling Users to interact with business operators (APTs and Providers), and, where applicable, to book Products outside the Online Information Hub on the channels of Providers and APTs.  The Company shall not be a party to any agreement between the Users and Providers, and does not conduct any prior checks on Content published by third parties. 

5. Notices and Complaints 

5.1 A form for submitting a notice regarding illegal or inappropriate Content under Article 3.1, letter b) above is made available to the Company by writing to: webmaster@trentinomarketing.org. To be deemed “complete” and sufficient to provide actual knowledge, a notice must contain the information provided for under Article 3.3 above. The Company sends an automatic confirmation of receipt of the notice; gives priority to notices submitted by trusted flaggers, appointed under the DSA; takes measures against any misuses of the notice-and-action system.

5.2 In the event of decisions affecting the Content or accounts of Users, the Company promptly notifies the affected parties by sending a statement of reasons explaining a) the legal ground relied on in taking the decision; b) the facts and considerations that led to the decision; c) information on how to lodge an appeal against the decision. Where applicable, the Company transmits relative information to the European Commission’s transparency database, within the limits and in the manners laid out under the DSA.

5.3 The User concerned by a moderation decision may lodge an internal complaint within 30 days from the date of the receipt of the notification sent via email, using the dedicated channels. 

The Company reviews the appeal and informs the User of the decision taken, providing the reasons thereto. Disputes may also be resolved by engaging in out-of-court dispute settlement by certified bodies meeting the requirements set out under the DSA; an updated list of such bodies, and instructions how to access the same are provided in Article 20.2 below.

5.4 Notices regarding illegal or inappropriate Contents are regulated under Article 3. The Company undertakes to promptly review the content of a notice and to remove or disable access to Content deemed illegal or manifestly inappropriate within 24 hours from completing said review.

5.5 In the event of repeated misuse of the Services (including the repeated uploading of illegal content), the Company may adopt proportionate measures, including notices, functionality restrictions or temporary suspension of an account, after sending a notification including a statement of reasons for such decisions, and providing Users the possibility to lodge an appeal.  

6.  Transparency 

6.1 The results displayed on the Digital Showcase Hub are ranked based on the main parameters listed below, in order of importance: online booking availability; content quality and completeness (content score); availability of translations. The above parameters may be combined with filters selected by the User. 

6.2 The Digital Showcase Hub makes available essential information on Providers who are qualified as professionals, including business name, registered address, contact details, registration number, VAT number, authorisations where applicable, and a contact channel. Providers are responsible for the accuracy of said information. It is understood that the booking process takes place entirely with the Provider, and the contractual relationship thereby established shall be between the User and the relative Provider.

6.3 Ban on misleading online interfaces (dark patterns). The Company undertakes not to use misleading online interfaces or interfaces that distort or impair the free and informed choices of Users. 

7. Use of the Services and Registration

7.1 Users may use the Services in two different ways: without registration or subject to registration for the creation of a Profile.

7.2 Access to Services without registration allows Users to browse through content that present and describe tourist offers across Trentino, in terms of events, festivals, accommodation, restaurants and other food-service establishments, museums, places of interest, weather information, and images, and to search for Products. 

7.3 Access to Services subject to registration and acceptance of these Terms and Conditions allows users to create a personal Profile and thereby use the functionalities designed to customise their tourist experience in the territory of Trentino. The creation of a Profile is free of charge. Registration is required to give Users access to Services made available exclusively to registered Users, and involves the creation of a single profile, valid for accessing all the Services made available by the Company, without requiring any further registrations.

7.4 The User shall be responsible for the completeness and accuracy of their personal details and other information provided to the Company upon registration.

         7.5     By registering and creating a Profile, the User undertakes to

       keep their access credentials, consisting of the e-mail address and password entered upon registration; the User acknowledges that access credentials are strictly personal, and agrees to safeguard the same with diligence and prevent access thereto by third parties.

       never allow others to use their Profile, and should they become aware of any unauthorised access by third parties, promptly inform the Company through the channels made available by the same in accordance with Article 13 (Assistance Services) of any fact that may have revealed the User’s access credentials to third parties, or of any other security breach of which they may become aware.

7.6       The User shall be responsible for safekeeping their access credentials. The User shall indemnify and hold the Company harmless from any liability arising out of any consequences and/or damages caused by any improper use of the credentials and/or use of the credentials by third parties, limited to the instances where such improper is directly attributable to the User’s failure to exercise due care in the custody of the credentials.  The above indemnification and hold harmless obligation shall not apply where the unauthorised use of the credentials is attributable to failures of the safety systems set up by the Company, or where the damages are caused by the wilful misconduct or gross negligence of the Company. A registered User may associate their “Trentino Guest Card” to their Profile to take advantage of the Card’s participating services.  For every booking and other operation connected to the Trentino Guest Card, please refer to the general terms and conditions for the issuing and use of the Card.

7.7       Every purchase and other operation connected to the “Transport” section relate to services provided by third parties. The Company is not a party to such contractual relationships, and shall not be held liable for any inaccurate information, errors, service disruptions, unavailability, or reimbursements, insofar as such issues are exclusively attributable to such third parties. 7.8       The use of the Services by the User is free of charge. The Company operates exclusively as a provider of a technological platform, and is not a party to the agreements that may be stipulated between the Users and the Providers. The Digital Showcase Hub is understood as a

tool to provide information and enable connections, and does not operate as an intermediary in commercial transactions. APTs and Providers are authorised to make use of the Digital Showcase Hub to autonomously promote their business activity and manage the Products’ sale process outside of the Digital Showcase Hub and in accordance with their own terms and conditions of sale. 

7.9       The Content that is accessible on the Digital Showcase Hub is published directly by APTs and Providers on their respective channels. The Company provides the technical infrastructure to access said Content, without making any changes thereto. APTs and Providers shall be personally and exclusively responsible for the Content they publish and for all the phases of the Product’s purchasing process, including the accuracy, completeness, truthfulness, and legal compliance of the Content relative to the Products, their prices, and the quality thereof. Bookings are finalised entirely on the booking systems managed by APTs and/or Providers, whereby a contractual relationship is established exclusively between the User and the relevant Provider, and the Company shall not be a party thereto. For the removal of illegal Content, the procedures established under Article 3 shall apply.

7.10    Access to the Services grants the User a non-exclusive, revocable, non-transferable, and nonsublicensable license to use the same. Users are prohibited from reproducing, distributing, altering, transforming, or adapting the Services, including the Website and the App, develop derivative software using the principles or source code of the Website or the App or of any other digital channel of the Digital Showcase Hub, or to use any of the foregoing for unauthorised commercial purposes or otherwise inconsistent with these Terms and Conditions.

7.11    The APTs and the Providers shall also be responsible for complying with legal obligations connected to the conduct of their business activity and the conclusion of online contracts, and for the lawfulness of any materials they publish. The liability of the Company shall be limited exclusively to wilful misconduct or gross negligence in the provision of the technological infrastructure services it provides, with express exclusion of any personal injury, and without prejudice to the mandatory statutory rights afforded to consumers.

8. Profile Deletion and Right of Termination

8.1 Users may stop using the Services at any time, by uninstalling the App from their device or discontinuing access to the Website. Stopping use of the Services does not entail the automatic deletion of the Profile, which shall remain active to allow for any future use of the Services. 

8.2 A User may delete their Profile by accessing the dedicated section on the Digital Showcase Hub, or otherwise request the deletion of their Profile by writing to; privacy@trentinomarketing.org. 8.3 When a Profile is deleted, any existing bookings or Services activated with third parties (Trentino Guest Card, transports, bookings with Providers) shall continue to be regulated under their respective terms and conditions, and shall not be automatically deleted.

9. Data Usage

9.1 Use of the Services requires wireless or mobile data access, the operation of which remains entirely within the User’s control and responsibility. Electronic communications service providers may charge a fee for data traffic access in connection with the use of the Website, the App, and the other digital channels. Such fees, costs, or charges charged by third parties shall remain the exclusive responsibility of the User.

10.              GPS and estimated time of arrival

10.1 Some Services accessible through the App use GPS data to estimate distances and travel time to the destinations selected by the User. Please be advised that a continuous use of GPS in the background may significantly reduce your device's battery life. 

10.2 The data-traffic charges contractually set by the Users’ electronic communications service provider may also apply, depending on the tariff plan Users have subscribed to. Such tariffs, in addition to any costs and fees charged by third parties, shall be under the exclusive responsibility of the User.

10.3 The travel indicated in the App and/or the Website are understood to be estimates that may be affected by a number of factors including traffic, weather conditions, changes to normal traffic road conditions, etc.

11.              Artificial Intelligence Functionalities

11.1 The Services may use artificial intelligence functionalities to improve the User’s experience with the Services, and to offer personalised itineraries, suggestions, summaries, and recommendations based on the preferences indicated by the User (e.g., period, location) and

the content available on the Platform and trusted third-party sources. The User is informed that it shall interact with an automated system providing virtual assistance/recommendations, and shall refrain from entering any personal data capable of identifying individuals while using the Services with integrated AI systems.

11.2 The Services that integrated AI systems - particularly Trentino Travel Assistant - may be used by registered Users as well as guests, meaning unregistered Users; in this last case, once the limited number of uses indicated upon opening the Service is exceeded, the User shall be required to register and create a User Profile in order to continue using the Service.  It is understood that all information relating to the Users’ interaction with the AI systems shall be retained exclusively for the duration of the session and shall be erased once the session is closed.

11.3 The suggestions formulated by the AI system are intended for information only and to provide support in organising travel options, and do not constitute professional advice, nor contractual obligations of the Company or the Providers. Travel times, availability, prices, and terms and conditions may be subject to change and must be verified at all times with the relevant Provider before confirming a booking.

11.4 AI-generated or modified text or images are clearly indicated as such where applicable. Where synthetic images or multimedia elements that do not correspond to real locations are used, the Platform clearly marks them as such.

11.5 The Company undertakes to adopt technical and organisational measures proportionate to the state of the art and the reasonably available resources in order to minimise errors, biases and misleading or deceptive content; however, due to the inherent nature of artificial intelligence systems, the Company cannot guarantee that automated responses will be free from inaccuracies. The User is required to independently confirm essential information (e.g., opening times, weather conditions, seasonal closures, access requirements) before undertaking activities or making purchases. 

11.6 It is prohibited to use Trentino Travel Assistant for any purposes in contrast with the law, to generate or solicit illegal or harmful content, or to attempt to circumvent any security measures.  The User shall be responsible for each individual request they formulate (prompts), and for the instructions and content they enter into the system.

11.7 Additional details on the operation of Trentino Travel Assistant are available on request.

12.              Intellectual Property

12.1 The Company represents to be the holder and/or licensee of all the intellectual property rights relating to and/or concerning the Services, without prejudice to any rights of the Providers in the Products and services  they offer.  The User may access the Services offered solely for personal and non-commercial use.

12.2 Any unauthorised use constitutes an infringement of intellectual property rights, and may result in civil and/or criminal liability charges against the User based on the infringement of said rights.

12.3 These Terms and Conditions do not grant the User any right or license in respect of the App, the Website, and/or any of the content and/or material made available therein. Any other use or reproduction of the App, the Website, or the material or content present therein is strictly prohibited.

12.4 It is furthermore strictly prohibited to make any use, whether direct or indirect, of the content, the material, or any information obtained through the Website, the App, and the additional digital channels within the Digital Showcase Hub, for scraping or data mining purposes, or to train, develop, improve, or test artificial intelligence or machine learning systems or similar technology. Any use for the above purposes is expressly prohibited and shall constitute a material breach of these Terms and Conditions.

13.              Assistance Service 

13.1 The Company makes the assistance service described below available to Users.

13.2 All service requests must be submitted through the section dedicated to  the assistance service:

-         Technical Assistance: to address and resolve any issues, questions, and service requests relating to the features and functionalities of the Services. Technical assistance is provided directly by the Company.

-         Tourist Assistance: to answer any questions/service requests regarding accommodation facilities, attractions, restaurants, excursions, and all other tourist information featured on the Digital Showcase Hub. Tourist Assistance is provided directly by the relevant tourist organisations and not by the Company. The Company therefore declines any and all responsibilities in connection to any errors, inaccuracies, or delays in providing answers, which shall be under the exclusive responsibility of the relevant tourist organisations.

13.3    Users shall receive the answers to their service requests via e-mail. Open and closed service requests can be accessed exclusively through the App. Notifications relate to the Services and the operation thereof, without any direct connection to the device from which the Services are accessed.

13.4    The User may open a service request or submit a question by  making a selection from the dropdown menu which features a list of pre-defined categories, to which the User may add a specific description of the issue or request. 

14.              Processing of Personal Data

14.1 The User’s personal data entered through the App shall be processed in compliance with the privacy notice published on the App, and the data entered through the Website shall be in accordance with the privacy policy published on www.visitrentino.info. 

14.2 You may contact the Company to exercise the rights afforded to data subjects by writing to:

privacy@trentinomarketing.org. You can write in Italian or in English.

15.              Suspended Access to the Services

15.1 Access to the Services may be temporarily or permanently suspended by the Company i) due to unforeseeable circumstances or events of force majeure; ii) as a result of the User’s breach of any one of the obligations under these Terms and Conditions; iii) due to upgrade, repair, or maintenance operations; iv) to comply with an order issued by any competent authority.

15.2 The Company shall adopt, where reasonably possible, appropriate measures to inform Users in the event of a scheduled discontinuation of the services.  The suspension of the Services for the above reasons shall not give rise to liability on the part of the Company.

15.3 In the event of suspension due to breach of the User’s obligations, the Company shall provide a statement of reasons, and, where appropriate, the option to remedy such breach before the suspension becomes final.

16.              Severability

16.1 Should any of the provisions of these Terms and Conditions be found to be invalid, such provision shall not be regarded to form a part thereof, and shall not affect the validity of the remaining provisions, which shall continue to be valid and to apply to the extent permitted by law. 

17.              Changes to the Terms and Conditions

17.1 The Company reserves the right to make any changes to these Terms and Conditions for justified reasons, including, but not limited to (a) bring the Terms and Conditions to compliance with new laws and regulations, including decisions by competent authorities; (b) technological upgrades to the Digital Showcase Hub requiring changes to the Terms and Conditions of use; (c) material changes to the Services offered or the Company's operating model. Every change shall be notified with at least 30 days’ prior notice by publishing the same on the Digital Showcase Hub, and, where the User provided an e-mail address, by sending Users a notification to said address. All past versions of the Terms and Conditions are filed and made accessible to Users on the Digital Showcase Hub.

17.2 In the event of material changes affecting the rights of the User, the latter may opt out of these Terms and Conditions within 30 days of the relevant notification, by deleting the Profile as outline in Article 8 above, without the application of penalties or additional charges.  Should the User take no action to exercise their right to opt out within the above 30-day period, the Terms and Conditions shall be regarded as having been accepted by the User.

18.              Point of Contact (DSA)

18.1 The Company makes available a point of contact for Authorities and Users for the purposes of Regulation (EU) 2022/2065 (Digital Services Act, or “DSA”), which can be contacted by writing to: direzione@trentinomarketing.org. Communications to the point of contact can be written in Italian or in English.

20.              Applicable Law and Jurisdiction

20.1 Any dispute arising out of the use of the Service shall be governed by Italian Law.  To resolve any disputes arising out of the interpretation, performance, or termination of these Terms and Conditions, 

       if the User is classified, under Legislative Decree No. 206 of 06/09/2005 (Consumers’ Code) as a Consumer, jurisdiction shall lie with the courts of the place where the User resides or is domiciled, provided such residence or domicile is located within the territory of the Italian State; 

       if the User is not classified as a Consumer, jurisdiction shall lie with the Court of Trento.

20.2 A User who intends to contest a decision adopted by the Company under the “Notices and Complaints”  section (e.g. removal or disabling of content, restricted visibility, suspension or closing of the account) may seek recourse, in addition to the internal system for the submission of complaints, through the out-of-court dispute settlement mechanisms recognised under Regulation (EU) 2022/2065 (Digital Services Act). An updated list of certified out-of-court settlement bodies (ODS) under the DSA,  including access procedures, languages covered, timeframes and applicable costs, is published on: https://digitalstrategy.ec.europa.eu/it/policies/dsa-out-court-dispute-settlement. Access to out-of-court dispute settlement bodies (ODS) under the Digital Services Act (DSA) shall not affect to the User's right to bring proceedings before the competent judicial authority.
